The good news is that provisional drivers (P Plate drivers) have the right to appeal the RMS decision in the Local Court of New South Wales.

The Court has a discretion to allow you to keep your licence on appeal. The Magistrate can either allow the appeal, deny the appeal or reduce the suspension period.

To have the best chance of succeeding you should:

  1. Make sure you lodge your appeal within 28 days of receiving the notice of suspension;

  2. Consider completing a Traffic Offenders Program;

  3. Show that you have a genuine need for your licence (you drive for work or transport a sick relative);

  4. Show that you have a reasonable traffic record and are a person of good character;

  5. Have an explanation for committing the offence(s) (even if that explanation is you have no excuse- some times it is best to own up to your mistakes!);

  6. Engage a Lawyer who regularly appears in the Local Court and knows how to communicate effectively with the Magistrate to give you the best chance of success.

Case Example

Recently Partner John Vizzone acted on behalf of a female P Plate holder in their 30’s. He convinced the Magistrate to consider that she had a relatively good driving record and had a significant need for her licence for work. The appeal was upheld.
