After the Christmas holidays, people in a bad relationship will usually make decisions that will affect their whole life.
Before you even consider moving out you should consult a Family Law Specialist.
BEWARE Your rights may not be affected by you moving out of your home under the Family Law Act.The Family Law Act, however, before you do move out of the matrimonial home you should seek legal advice so that you can determine your position. Some of the things that you need to consider are:
Can I purchase the matrimonial home?
If the matter does not settle and goes to Court, can I afford to rent for that period of time?
The Family Law Act was amended in 1975 to allow for no-fault Divorce. The only ground for Divorce is an irretrievable breakdown of marriage for a period of 12 months or longer.
Sometimes, it may be that you need an Apprehended Violence Order or you may need an Application to the Court for your spouse to move out of the matrimonial home.
That is why it is important to seek legal advice because there are a number of options available to you.
