Family law lawyers have been in the media spotlight of late, thanks to a Family Law Court Judge who has blasted family law firms for gross overcharging.

Justice Benjamin was quoted by the Sydney Morning Herald as criticising “win at all costs, concede little or nothing, chase every rabbit down every hole and hang the consequences approach to family law litigation”. In the case that earned His Honour’s ire, the parties forked out over $860,000 in costs on their solicitors alone! With barrister fees, the actual legal costs of the case could have easily been in excess of $1 million.

As Justice Benjamin points out, this kind of spending on lawyers leaves little important money to support and provide for children whom are already in a difficult part of their lives as a result of the separation.
