VRA Tip of the Week: Divorce Invalidates A Will

Did you know that a Divorce Order will automatically invalidate any Will made during your marriage that makes provision for your spouse?
However, it is important to remember that merely ‘separating’ from your spouse will not invalidate such a Will.
A helpful tip is that you should do a new Will shortly after you separate so that your spouse does not inherit anything under your Will in the intervening time between your separation and the granting of a Divorce Order.
If a new Will is made after separation, your Lawyer can also include a special clause so that that your Will remains valid even after your Divorce Order. This means that you will not need to review your Will for a second time after your Divorce Order is granted.
